The Committee on Finance moves to amend the bill by striking
out everything after the enacting clause and inserting in lieu
thereof the following:
"That the balance of the funds available for expenditure in
the fiscal year ending June 30, 2010, to the Lottery Commission -
Video Lottery Income Fund, fund 7203, fiscal year 2011,
organization 0705, be decreased by expiring the amount of
$53,463,000 to the unappropriated surplus balance of the State
Fund, General Revenue, to be available for appropriation during the
fiscal year 2010.
And, That the total appropriation for the fiscal year ending
June 30, 2010, to fund 0101, fiscal year 2010, organization 0100,
be supplemented and amended by increasing an existing item of
appropriation as follows:

Any unexpended balance remaining in the appropriation for
Pension Merger Administrative Costs (fund 0195, activity 429) at
the close of the fiscal year 2009 is hereby reappropriated for
expenditure during the fiscal year 2010.
The division of highways, division of motor vehicles, public
service commission and other departments, bureaus, divisions, or
commissions operating from special revenue funds and/or federal
funds shall pay their proportionate share of the retirement costs
for their respective divisions. When specific appropriations are
not made, such payments may be made from the balances in the various special revenue funds in excess of specific appropriations.
The above appropriation for Supplemental Benefit Enhancements
for Annuitants (activity ___) may be transferred to the appropriate
special revenue funds of the Consolidated Public Retirement Board
for expenditure as determined by the executive secretary pursuant
to WV Code §5-10-22k and §18-7A-26v.
And, That the total appropriation for the fiscal year ending
June 30, 2010, to the fund 0595, fiscal year 2010, organization
0703, be supplemented and amended to read as follows:

Unclassified-Total-Surplus (fund 0420, activity 284) at the close

The above appropriation shall be transferred to Division of
Human Services for Health Care and Title XIX Waiver for Senior Citizens to be used with the federal moneys generated thereby shall
be used for reimbursement for services provided under the program.
Further, the program shall be preserved within the aggregate of
these funds.
The purpose of this bill is to expire funds into the
unappropriated surplus balance in the state fund, general revenue,
and to supplement, amend, add and increase items of appropriation
in the aforesaid accounts for the designated spending units for
expenditure during the fiscal year 2010.".
